    Salve,

    io ed il mio compagno egiziano, ci siamo uniti con Orfi ma non registrato. Ora vorrei sapere se posso registrare all'anagrafe il nostro bimbo, poichè non siamo ancora marito e moglie. All'ufficio hanno fatto qualche problema...Vorrei avere informazioni, per favore.

    Ciao Fatima, scusami mi è stato detto che l'Orfi legalizzato in un tribunale è un matrimonio vero e proprio ed è riconosciuto dalla legge egiziana, perchè dici questo?

    ☆ORFI CONTRACT ☆

    (Common Law Marriage & Contract)

    If you wish to marry in Egypt with a local resident, here are some details you need to know!
    *This is a very Legal contract as it is a Contract signed w 2 witnesses... and all details mentioned in it are legal and binding on both parties.
    *Your Orfi marriage in Egypt can later be recognized as a True legal one with all rights & responsibilities in 2 ways.
    By registering in Court...or by simply taking your Contract to MOJ and trading it for a legal marriage contract!

    In Egypt, Marriage is of two kinds:
    #1-ORFI ... #2-Official Marriage.

    The details of each of them are as follows;

    Any marriage to a citizen of Egypt begins with a Prenuptial agreement or Marriage contract. This contract is, in fact, a "Civil marriage or Common law Marriage known in Egypt as Orfi Marriage. It is a Legal Binding Contract, and so should be written up and discussed at a Trusted Lawyers Office, and requires Only Id, and 2 Witnesses. Once both parties agree to the details in the contract, and sign, Your married!
    And this gives a Fast & easy legal way for a citizen of Egypt to be in an intimate married relationship with a citizen of a foreign state.
    Why do you need this? Without this document, you should not enter any apartment alone together... Sometimes couples who do not have such a contract, attempt to go alone into a flat or home, and put themselves at great risk!
    IF ANYONE calls the police or the police happen to be checking door-to-door they will both be arrested or at the very least, the Egyptian one might end up spending time at the police station and it is a very embarrassing situation for both parties.
    Having a Lawyer officiate your Orfi Contract is much safer & better!

    ☆THE RIGHTS AND DUTIES OF ORFI CONTRACT ☆

    *This type of of marriage does not confer ANY rights, such as property claims or inheritance but allows a couple to stay in a flat alone together and gives one time to decide if a Formal Legal marriage is in their best interest.
    * added note;
    Any marriage contract is meant to be for the benefit of the WOMAN!
    As it is a Prenuptial contract, she should write ANY conditions she demands such as; the value of her Bride gift *if she asks for a Khula- divorce, this amount would need to be returned.
    Also, it must mention **the amount she requires in case of divorce, AND ***ANY OTHER Conditions she may desire, such as The Right to Divorce(fast!at her option).
    Alasma fi idee.
    The Divorce settlement may include a signed Bank check.!
    ** You should also know that the man has a right to make as many ORFI marriages as he wants without the consent or knowledge to the woman with whom he signed the ORFI contract.

    ***On a positive note, any children who may be born during this Orfi contract WILL get the right to their father's name.( So, SafeGuard That Contract!!!)

    *Unlike the Man, The Woman cannot remarry or cheat on her Husband and only HE has the right to file an Adultery case against her (Zina case ) Should she be unfaithful.
    ** In case of a Divorce, the woman has no right to get alimoney, *UNLESS stipulated in this contract.
    *Also, No right to apply for Marriage or Resident Visa.
    ************
    Your Orfi Marriage only requires 2 adult male witnesses.
    If the witnesses are to be only women - you will need 4, as two women are equal to one man in witnessing contracts(in case one of them forgets a detail the other can remind her).

    ■Note: ORFI contract, like ANY Contract in Egypt, MUST BE drawn up in two copies, in Arabic and English(or your native language) And one set of copies for each of the happy couple! BE SURE to put your copy in a safe place, including Scanning to your email!▪

    If you one day descide to get serious, then your ORFI contract can be legalized by the court or taken to MOJ, and then be recognized as a full Valid Marriage with ALL your rights in Egypt , but Orfi alone gives NO rights to live and work in Egypt. *Only when you register your Orfi contract at the Court or MOJ can your Orfi marriage become a FULL legalized marriage that then gives many benefits for women, such as 5 year Marriage Visa & the right to apply for Residency, and citizenship and more...

    ☆HOW TO ANNUL AN ORFI CONTRACT ☆

    According to the Law an Orfi marriage is considered an a kind of offical marriage.
    So the wife and husband have to follow SIMILAR standards
    for divorce as in official marriage. BUT...

    There are three ways to get out of the Orfi contract:

    1. Husband can make any divorce offical by a notary.

    2. Nullify the contract if both sides agree. ( for example BURN ALL 4 ORIGINAL copies of the contract. )

    3. Wife Files a case in court with her Origional Orfi contract if the husband refuse to divorce or the husband disappears.

    But what would the wife do if the wife no longer has the Original contract and the husband refuses to divorce or she is no longer able to contact him???
    In that case the marriage remains legal. It would be a crime for her to marry again...AND if she HAS entered into a second marriage,well, according to the law, if he proves her Orfi by any proofs for exmple; Phone chats and internet contact or even recored phone calls or any weak written paper can be considered proof or by witness
    then she can possibly be arrested.!!!

    Ciao, non so se hai poi risolto, io avevo il tuo stesso problema, abbiamo avuto la prima bambina fuori dal matrimonio,avevamo cmq fatto l orfi ma non è un vero contratto quindi siamo andati in ambasciata per sposarci legalmente, avuto il nulla osta siamo andati all ufficio matrimoni e abbiamo fatto cambiare la data sul contratto che risulta quella dell'orfi,che hanno legalizzato è una cosa semplicissima e veloce;ci è stato suggerito in ambasciata di fare cosi;probabilmente hai gia risolto magari la mia esperienza può cmq servire ad altri;

    ti dicono in ambasciata cosa inserire,a noi hanno fatto tutto loro, poi all'ufficio matrimoni a me hanno chiesto di elencarli a voce alta in inglese;esempio: che puoi lasciare l Egitto e lavorare senza il suo permesso,portare con te i figli, separazione o comunione dei beni ecc...
